SHORT COURSE COBEM 2023: FUNDAMENTALS OF INTELLECTUAL PROPERTY FOR SCIENTISTS AND ENGINEERS

McQuay Intellectual property protection is essential to fostering innovation and a strong and enforceable patent is required for the protection of important technology for commercialization. A lack of exploration of IP rights, substantially limits the amounts of funds available for artists and researchers to engage in creative activities and research and development, while, at the same time, reducing the visibility of their institution to their peers. Without protection of ideas, businesses would not reap the full benefits of their inventions, particular small businesses and those dealing with breakthrough technological advances that require large sums of resources for development. Unfortunately, engineering and science education curricula are void of any effort to teach the basics of IP and how engineers and scientists – those contributing the most to inventions – should avoid even the simplest pitfalls about IP protection of their innovations. This presentation will first provide an overview of the basic concepts of intellectual property law, including patents, trademarks, trade secrets, and copyrights. The interplay, differences and relationships between each of these types of IP will also be discussed. We will then focus on the necessary working knowledge from a legal perspective related to several important issues in the preparation and prosecution of patent applications, including patentability, preparation of strong and enforceable patent applications, claim and specification drafting, and licensing. The role that inventors and other persons involved in the creation of new technology, such as students, scholars, and tech-transfer professionals, will be discussed so as to assure the development of the needed legal protection for a successful product.
